Mobile Terms of Service

The Wagmist mobile message service (the "Service") is operated by Jojo Gambino ("Wagmist", "we", or "us"). Using the Service means you agree to these terms ("Mobile Terms"). We may change or cancel the Service or any of its features without notice. To the extent the law allows, we may also change these Mobile Terms at any time, and continuing to use the Service after a change takes effect means you accept it.
What you're agreeing to
By opting in to Wagmist text messages, you agree to receive recurring SMS/text messages from and on behalf of Wagmist through your wireless provider to the mobile number you gave us, even if that number is on a state or federal Do Not Call list. Messages may be sent using an automatic telephone dialing system or other technology. Service messages may include order updates, account alerts and similar information. Promotional messages may include offers, specials, new arrivals and cart reminders.
You do not have to sign up for texts to buy from us. Consent is not a condition of any purchase, and taking part is entirely voluntary.
Cost and frequency
We do not charge for the Service, but you are responsible for any charges or fees your wireless provider applies to text messages. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details.
Opting out
You can opt out at any time. Reply STOP to any text we send, or use the unsubscribe link in a message where one is included. You'll get a one-time confirmation text and then nothing further, unless you start a new conversation. If you're signed up for more than one Wagmist mobile program, opt out of each one separately by following the instructions in its own terms, except where the law says otherwise.
Help
For help with the Service, reply HELP to any text we send, or email support@wagmist.com.
Numbers and delivery
We may change the phone number we text from at any time and will let you know when we do. Messages sent to a number we have stopped using, including STOP or HELP requests, may not reach us, and we can't act on requests we don't receive. The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to give us a valid mobile number; if you get a new one, sign up again with it.
To the extent the law allows, we are not liable for failed, delayed or misdirected delivery of any information sent through the Service, for errors in that information, or for anything you do or don't do in reliance on it.
Privacy
We respect your privacy. How we collect and use your personal information, including your mobile number, is explained in our Privacy Policy. We will not share your mobile information or opt-in consent with third parties or affiliates for marketing or promotional purposes.
